Terms of Service
These Terms of Service apply to all purchases made through Fit With Intelligence at fitwithintelligence.com.
By placing an order through our website, you enter into an agreement with Fit With Intelligence and confirm that you have had the opportunity to review these Terms of Service before completing your purchase.
Article 1. Definitions
For the purpose of these Terms of Service:
Fit With Intelligence
The seller and operator of fitwithintelligence.com.
Customer
Any person who purchases or intends to purchase products through our website.
Consumer
A natural person acting for purposes outside their trade, business, craft, or profession.
Products
The physical products offered for sale through Fit With Intelligence.
Agreement
The purchase agreement concluded between Fit With Intelligence and the customer.
Website
The online store available at fitwithintelligence.com.
Article 2. Applicability
These Terms of Service apply to all offers, purchases, and agreements made through our website.
Before completing an order, customers are given the opportunity to review the applicable terms and relevant information concerning the order.
Any deviation from these terms is only valid when expressly agreed in writing.
Mandatory consumer rights granted by applicable law remain unaffected.
Article 3. Products and availability
We aim to display our products, colours, descriptions, sizes, and other product information as accurately as possible.
Because colours may appear differently depending on the screen or device used, minor visual differences may occur.
All products are subject to availability.
If a product becomes unavailable after an order has been placed, we will contact the customer as soon as possible and provide an appropriate solution, including a refund where applicable.
Article 4. Prices and payment
Prices are displayed in the currency applicable to the customer’s selected Shopify market.
Prices include applicable taxes where required, unless otherwise indicated during checkout.
Shipping costs and any other applicable charges are displayed before the customer completes the order.
Payment must be completed using one of the payment methods available during checkout.
The payment methods offered may vary depending on the customer’s country, currency, and eligibility.
The price displayed and accepted during checkout applies to the order.
Article 5. Orders and agreement
An order is placed when the customer completes the checkout process.
After placing an order, the customer will receive an electronic order confirmation.
Fit With Intelligence reserves the right to refuse or cancel an order where there is a legitimate reason to do so, for example in the event of:
Incorrect pricing or product information
Suspected fraud or misuse
Product unavailability
Technical errors affecting the order
If payment has already been received for an order that we cancel, the applicable amount will be refunded.
Article 6. Shipping and delivery
Orders are shipped to the delivery address provided by the customer during checkout.
Current shipping destinations, shipping costs, free shipping thresholds, and estimated delivery times can be found on our Shipping & Delivery page and are displayed during checkout.
Orders are normally processed within 1 business day.
Estimated delivery times are not guaranteed and may be affected by carriers, customs procedures, public holidays, promotional periods, weather conditions, or other circumstances outside our reasonable control.
Where no specific delivery period has been agreed, applicable consumer law regarding delivery times remains fully applicable.
For deliveries outside the European Union, customs clearance may occasionally result in additional delays.
Article 7. Right of withdrawal
Consumers purchasing online generally have the right to withdraw from their purchase within 14 days after receiving the products, without providing a reason.
The customer may exercise this right through the withdrawal option available on our website or by clearly informing Fit With Intelligence of the decision to withdraw.
After notifying us of the withdrawal, the products must be returned in accordance with the instructions provided in our Refund Policy.
Customers are responsible for the direct cost of returning products unless:
The product was delivered incorrectly
The product is defective
Fit With Intelligence explicitly agrees to cover the return costs
We recommend reviewing our Refund Policy before returning an order.
Article 8. Condition of returned products
During the withdrawal period, customers may inspect a product to the extent reasonably necessary to determine its nature, characteristics, and fit.
Products should be returned in a condition that reasonably reflects such inspection.
If a product has been handled or used beyond what is reasonably necessary and this results in diminished value, Fit With Intelligence may be entitled to deduct the resulting loss in value from the refund where permitted by law.
Article 9. Refunds after withdrawal
When a valid withdrawal is exercised, Fit With Intelligence will refund the payments that must legally be reimbursed within 14 days after being informed of the withdrawal.
We may wait until the returned products have been received or until the customer provides sufficient evidence that the products have been returned, whichever occurs first.
Where required by law, the standard outbound delivery costs will also be refunded.
Additional costs resulting from the customer choosing a more expensive delivery method than our standard option do not have to be reimbursed.
Refunds are normally issued to the original payment method.
Article 10. Exceptions to the right of withdrawal
The statutory right of withdrawal does not apply where an exemption under applicable law applies.
This may include, among other things:
Products made according to the customer’s specifications or clearly personalised
Sealed products that are unsuitable for return for health protection or hygiene reasons after the seal has been broken
Exceptions are applied only where legally permitted and where the customer has been properly informed.
Article 11. Legal guarantee and conformity
Customers are entitled to receive products that conform to the agreement and can reasonably be expected to function and perform as described.
If a product is defective, damaged, incomplete, or otherwise does not conform to the agreement, statutory consumer rights apply.
Depending on the circumstances, this may include repair, replacement, a price reduction, or a refund.
Any commercial warranty offered by Fit With Intelligence or a manufacturer is additional to these statutory rights and does not replace them.
Article 12. Complaints and damaged products
If you receive an incorrect, damaged, or defective product, please contact us as soon as reasonably possible.

Customers retain all statutory rights regardless of our internal complaint procedures.
Article 13. Risk during delivery
The risk of loss or damage to a product generally passes to the consumer when the consumer, or a third party designated by them, physically receives the product.
Where the customer independently appoints a carrier that was not offered by Fit With Intelligence, different statutory rules may apply.
Article 14. Website information and errors
We aim to ensure that all information on our website is accurate and up to date.
However, typographical errors, technical errors, incorrect product information, or incorrect pricing may occasionally occur.
Where an obvious error affects an order, we may contact the customer to correct the situation or cancel the affected order and issue an applicable refund.
Nothing in this article limits statutory rights relating to misleading or incorrect information.
Article 15. Promotions and discount codes
Promotional offers and discount codes may be subject to additional conditions communicated as part of the promotion.
Unless explicitly stated otherwise:
Discount codes cannot be exchanged for cash
Discounts cannot be applied retrospectively to completed orders
Only eligible products and orders qualify
Fit With Intelligence may withdraw or change a promotion before an order has been completed
The conditions applicable when an eligible order is placed remain applicable to that order.
Article 16. Liability
Nothing in these Terms of Service excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.
Fit With Intelligence is not responsible for damage resulting from misuse of products, failure to follow applicable care instructions, or circumstances attributable to the customer.
Any limitations of liability are subject to mandatory consumer protection law.
Article 17. Force majeure
Fit With Intelligence is not responsible for failure or delay caused by circumstances reasonably beyond our control.
Such circumstances may include severe weather, natural disasters, war, strikes, carrier disruptions, customs delays, government measures, widespread technical failures, or other comparable events.
Where such circumstances materially affect an order, we will aim to inform the customer and find an appropriate solution.
Article 18. Privacy
Personal data is processed in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR) where applicable.
Information about how we collect, process, store, and protect personal information can be found in our Privacy Policy.
Article 19. Intellectual property
Unless otherwise indicated, the content available through fitwithintelligence.com, including logos, branding, product designs, graphics, photography, text, and other materials, belongs to or is licensed to Fit With Intelligence.
Such materials may not be reproduced, distributed, commercially exploited, or otherwise used without prior permission where protected by intellectual property rights.
Article 20. Changes to these Terms
We may update these Terms of Service when necessary, for example due to changes in our business, website, services, or applicable legislation.
The version applicable to an order is the version that was in effect when that order was placed.
The latest version will always be available on our website.
Article 21. Governing law and disputes
These Terms of Service and agreements with Fit With Intelligence are governed by Dutch law.
For consumers, this choice of law does not deprive them of mandatory consumer protection rights that apply under the laws of their country of residence.
We aim to resolve complaints and disputes directly and reasonably wherever possible.
If a dispute cannot be resolved mutually, either party may use the courts or other dispute resolution options available under applicable law.
