General Terms and Conditions – Fit With Intelligence

Article 1. Definitions

In these general terms and conditions, the following is understood to mean:

  • Fit With Intelligence: the company that sells and manages products via the website fitwithintelligence.com .

  • Products: all goods offered by Fit With Intelligence, both physical and digital.

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement with Fit With Intelligence.

  • Agreement: any purchase agreement or order between Fit With Intelligence and the consumer regarding the delivery of products.

  • Website: the online environment of Fit With Intelligence where products are offered and sold.

Article 2. Applicability

These general terms and conditions apply to all offers, orders, and agreements between Fit With Intelligence and the consumer, as well as to the use of the website.
Deviations are only valid if agreed upon in writing and explicitly.

By placing an order or using the website, the consumer declares to have read these terms and conditions and to agree to them.

Article 3. Prices and payment

  1. All prices are quoted in euros and include VAT, unless otherwise indicated.

  2. Any shipping and handling fees will be stated separately before the order is finalized.

  3. Fit With Intelligence reserves the right to change prices. The price applicable at the time of ordering is binding.

  4. Payment must be made in full via the offered payment methods before delivery takes place.

  5. In the event of late payment, Fit With Intelligence reserves the right to terminate the agreement.

Article 4. Right of withdrawal and returns

  1. The consumer has the right to withdraw from the agreement without giving reasons within 14 days of receipt of the product.

  2. During this period, the consumer must handle the product and the packaging with care.

  3. The product may only be handled to the extent necessary to determine its nature, characteristics, and functioning.

  4. If the consumer exercises the right of withdrawal, the product must be returned in its original condition and packaging.

  5. The costs of return are at the expense of the consumer, unless it concerns an incorrectly delivered or defective product.

  6. Exceptions to the right of withdrawal are:

    • Products manufactured according to consumer specifications (custom-made);

    • Sealed products that cannot be returned for hygienic reasons;

    • Digital content delivered immediately after ordering.

  7. Return requests can be submitted via info@fitwithintelligence.com , quoting the order number.

Article 5. Delivery

  1. Delivery takes place at the address specified by the consumer, while stocks last.

  2. Fit With Intelligence aims to ship orders within 3–5 business days after payment.

  3. In the event of delay or impossibility of delivery, the consumer will be informed thereof as soon as possible. In that case, the consumer is entitled to free cancellation and refund within 14 days.

  4. Fit With Intelligence is not liable for delays caused by third parties, such as carriers or customs procedures.

Article 6. Transport and risk

The risk of loss or damage to products passes to the consumer as soon as the product is received.
If the consumer chooses a carrier themselves, the risk passes upon transfer to this carrier.

Article 7. Retention of title

All delivered products remain the property of Fit With Intelligence until the consumer has fully met his payment obligations.

Article 8. Warranty and conformity

  1. Fit With Intelligence guarantees that the delivered products comply with the agreement and are free from defects that prevent normal use.

  2. Complaints must be reported in writing via fwiwebshop@gmail.com within a reasonable period, no later than 30 days after discovery .

  3. Fit With Intelligence will repair, replace, or (partially) refund the product at your choice.

Article 9. Liability

  1. Fit With Intelligence is not liable for damage caused by improper use of the products.

  2. Fit With Intelligence is not liable for indirect damages, consequential damages, or lost profits, unless caused by intent or gross negligence.

  3. The liability of Fit With Intelligence is in all cases limited to the amount of the purchase price of the relevant product.

Article 10. Force Majeure

Fit With Intelligence is not liable for damage or delay resulting from force majeure, including but not limited to: natural disasters, war, pandemics, strikes, carrier failures, government measures, or technical problems.

Article 11. Changes to prices, services, and conditions

  1. Fit With Intelligence reserves the right to change or discontinue prices, products, or services at any time without prior notice.

  2. For ongoing orders, the terms and conditions that applied at the time of ordering continue to apply.

  3. The most current version of the general terms and conditions is always available on the website.

Article 12. Errors and inaccuracies

Although Fit With Intelligence takes the utmost care to ensure the accuracy of information on the website, typographical errors or inaccuracies may occur. Fit With Intelligence reserves the right to correct such errors or cancel orders if an incorrect price or information is listed.

Article 13. Privacy

Fit With Intelligence processes personal data in accordance with the General Data Protection Regulation (GDPR).
Personal data is used exclusively for fulfilling orders and communication. See the privacy statement on the website for more information.

Article 14. Intellectual property

All rights to the content of the website, including texts, images, logos, and designs, belong to Fit With Intelligence.
It is not permitted to copy, reproduce, or publish any material without the written permission of Fit With Intelligence.

Article 15. Disputes

Fit With Intelligence strives to resolve complaints and disputes through mutual consultation.
If this proves impossible, disputes may be submitted exclusively to the competent court in the Netherlands.

Article 16. Final provision

By placing an order or using the website, the consumer agrees unconditionally to these general terms and conditions.
